Terms of Service

1. Who can use Night Vybes

• You must be 18 or older, and old enough to enter bars and nightclubs where you live. We may ask you to verify your age.
• You must not be someone we have banned before.
• One person per account. Keep your password safe; you are responsible for what happens on your account.

2. How posting works

• You can post only from the in-app camera, only while our servers confirm you are at an eligible venue, and only videos of 30 to 60 seconds. There is no live streaming and no uploading from your camera roll.
• We check location using your device's GPS and other signals. Trying to fake your location, or to get around any of these rules, breaks these terms.
• Posts are visible until 5 hours after they are recorded. We keep them for 3 more days for safety review, and longer while a report, appeal or legal request is open.
• We review posts, may mute audio, and may decline or remove any post.

3. Your content

• You own the videos you post. You give Night Vybes a worldwide, non-exclusive, royalty-free licence to host, store, show, process and distribute them in the app and to promote Night Vybes, for as long as they are kept under these terms.
• You promise you have the right to post what you post, and that it follows the Community Guidelines and the law where you film.
• Respect the people you film. Filming in a public venue may still be restricted where you are; you are responsible for following those laws and the venue's own rules.

4. Night Vybes Plus

• Watching and posting are free. Night Vybes Plus is an optional subscription for extra features, at $4.99 a month (or the local price shown in the store).
• Plus is bought through the Apple App Store or Google Play. It renews automatically each month until you cancel. Cancel at least 24 hours before renewal in your store account settings.
• Refunds are handled by Apple or Google under their rules. Features included in Plus may change; we will tell you before a change that reduces what you pay for.

6. What you must not do

• Break the Community Guidelines or the law.
• Fake your location, use bots or scripts, scrape the app, or copy its venue data.
• Try to get into accounts, systems or data that aren't yours, or interfere with how the app works.
• Use Night Vybes to stalk, track or find a specific person.
• Resell or reuse other people's videos outside the app.

7. Strikes, suspension and termination

• We enforce the Community Guidelines with strikes and bans as described there. You can appeal from the app.
• We may suspend or close an account to protect people, follow the law or stop misuse.
• You can delete your account at any time in the app (Profile, Delete account). This removes your profile and posts, except what we must keep for safety or legal reasons, as described in the Privacy Policy.

8. Venue information and safety

• Venue details, specials and crowd levels come from public data, venues and users. They may be wrong or out of date. Check with the venue before you rely on them.
• Night Vybes does not run, inspect or endorse any venue. Drink responsibly, never drink and drive, and look after yourself and your friends.

9. Disclaimers and limits on liability

• Night Vybes is provided "as is" and "as available", without warranties, to the extent the law allows.
• To the extent the law allows, we are not liable for indirect or consequential losses, or for what happens at venues or between users. Our total liability to you is limited to the greater of what you paid us in the last 12 months or $50.
• Some places do not allow these limits; where that is the case, they apply only as far as the law allows.
